Terms & Conditions for Photographic Competitions hosted by GnoMAD

  1. This competition is conducted by GnoMAD (ABN 44 760 943 949) of 24 Inveray Ave Jan Juc, Victoria 3228 Australia.

  2. The competition commences on the 1st of May 2018 at 0800 and concludes on the 31st of May 2018 at 1700.

  3. Photo captions must accompany all submissions, and should include the subject of the image, the location the image was taken, and the name of the photographer(s). Please clearly label animals in digital caption information to assist judges in determining eligibility.

  4. Participation is open to any Australian citizen or permanent resident of Australia, over the age of 18, who is not the owner (or the immediate family member of the owner or employee) of GnoMAD. GnoMAD reserves the right to confirm and verify that entrants are over the age of 18 by requesting proof in writing.

  5. The image may be watermarked but should be inconspicuous as to not distract from crediting the image.

  6. GnoMAD asserts no claims to the rights of any image entered into the competition except as expressed in these terms and conditions.

  7. If GnoMAD uses any images through website or social media channels the photographer / entrant will be credited. Entrants consent to the use of their images in this way.

  8. GnoMAD will never sell or look to profit directly from an entrant’s image.

  9. By entering the competition, entrants grant GnoMAD a perpetual, worldwide, royalty-free license to use credited images through GnoMAD’s website and social media channels and to use entrants’ images and names either on-line or in print media to promote the GnoMAD business at any time in the future.

  10. If entrants wish to withdraw the use of their image by GnoMAD, they must do so by contacting GnoMAD at gnomad1@outlook.com . GnoMAD will ensure to remove the entrants image from any future publication but will not remove any publications that have previously used the image.

  11. It is the entrant’s responsibility to protect their work from third parties by entering (but not limited to) metadata into the image. GnoMAD will not be liable for any misuse of images from third party sites.

  12. Each entrant acknowledges that GnoMAD is under no obligation to use their entry.

  13. Any use of the image in accordance with these terms and conditions will be at the discretion of GnoMAD.

  14. Each entry must be an original photograph produced entirely by the entrant. It must not contain any trade marks or copyright material owed whole or in part by a third party or violate any persons’ rights of privacy.

  15. All details provided by the entrant must be true and accurate

  16. Where there is an identifiable person in an image submitted, the entrant is responsible for ensuring that the person photographed is aware that their picture has been taken and may be distributed online. GnoMAD may wish to contact the entrant in this regard, to clarify no person will have their privacy breached prior to publishing the image.

  17. The image must not contain any material or content that is infringing, threatening, false, misleading, abusive, harassing, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic, profane or otherwise objectionable.

  18. The entrant represents and warrants that the work is the entrant’s sole original work, the entrant has the power to grant the rights given under it, the entrant has obtained appropriate releases, including location and performer’s releases, the entrant is entitled to reproduce and exploit any underlying rights in the work, and the entrant indemnifies GnoMAD against any loss resulting from breach of these warranties.

  19. The image must not plagiarise the work of any other person.

  20. The image must not contain any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability or otherwise violate any law either of the Jurisdiction or any other country whose laws may apply to the entry.

  21. You must not upload or send any content which might disturb or damage GnoMAD’s website or reputation.

  22. GnoMAD reserves the right in its sole discretion to disqualify any individual who GnoMAD has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. GnoMAD’s legal rights to recover damages or other compensation are reserved.
